| » What is Alternative Dispute Resolution? |
| Alternative Dispute Resolution is a way of resolving disputes between two or more parties without going to court. A third party, the mediator, assists the parties to negotiate their own settlement (this is called facilitative mediation). In some cases, mediators may express a view on what might be a fair or reasonable settlement, generally where all the parties agree that the mediator may do so (this is called evaluative mediation). When Mediation fails, Adjudication stars, adjudication is a legal process by which an arbiter reviews evidence and argumentation including legal reasoning set forth by opposing parties or litigants to come to a decision which determines rights and obligations between the parties involved. Where applicable, Association of Design can be considered the mediator and adjudicator for the agreements prepared by its members, if AoD cannot help the issue, will direct the matter to another entity. Alternative Dispute Resolution is especially good for small business who might not be able to afford attorneys fees or the litigation costs. |
